YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, DO NOT USE THE FONT SOFTWARE. USE OF THE \r
FONT SOFTWARE REQUIRES AND INDICATES ACCEPTENCE OF THE FOLLOWING TERMS\r

1. General\r

The software and documentation accompanying this License existing in whatever media (collectively the \r
“Font Software”) are licensed, not sold, to you by Proportional Lime Type Foundry for use only under the \r
terms of this License, and Proportional Lime Type Foundry reserves all rights not expressly granted to \r
you. The License herein is granted under Proportional Lime Type Foundry's intellectual property rights \r
of the Font Software and does not include any other intellectual property rights. This License will be \r
valid for any software upgrades provided by Proportional Lime Type Foundry that replace and/or \r
supplement the original Font Software product, unless the upgrade is accompanied by a new license, in \r
which case that license shall supersede and govern the Font Software.\r

2. Permitted License Uses and Restrictions\r

In consideration of your agreement to abide by the terms of this License, and subject to such terms, \r
Proportional Lime Type Foundry grants: an individual the right to use on up to five (5) personal \r
computers, a business twenty (20) computers, Schools may use one License per district, and \r
Universities and/or Colleges one License per Department.. You may not modify, decompile, reverse \r
engineer, disassemble, or create derivative works of the Font Software or any part thereof, unless \r
expressly permitted in this License or to the extent of applicable law, You may not sell, rent, lease, \r
lend, sublicense or distribute the Font Software. You may commercially distribute your materials that \r
were created using the Font Software or that incorporate the Font Software. THE FONT SOFTWARE IS \r
NOT INTENDED FOR USE IN THE OPERATION OF ANY EQUIPMENT IN WHICH THE FAILURE OF THE FONT \r
SOFTWARE COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL \r
DAMAGE.\r

3. Copies.\r

You may make copies of the Software provided that any such copy: is created as an essential step in \r
the utilization of the Font Software as licensed under this EULA, or is only for archival purposes to \r
back-up the Software. All trademark, copyright, and proprietary rights notices must be faithfully \r
reproduced and included by you on such copies. You may not make any other copies of the Software.\r

4. Termination\r

This License is effective until terminated. Your rights under this License will terminate automatically \r
without notice from Proportional Lime Type Foundry if you fail to comply with any term(s) of this \r
License. If the agreement is terminated all copies of the Font Software must be destroyed.\r

5. Disclaimer of Warranties\r

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE FONT SOFTWARE IS AT YOUR SOLE RISK \r
AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS \r
WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE FONT SOFTWARE IS \r
PROVIDED “AS IS”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND {PROPORTIONAL \r
LIME TYPE FOUNDRY AND PROPORTIONAL LIME TYPE FOUNDRY ’S LICENSORS (COLLECTIVELY REFERRED \r
TO AS “PROPORTIONAL LIME TYPE FOUNDRY ” FOR THE PURPOSES OF SECTIONS 4 AND 5) HEREBY \r
DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE FONT SOFTWARE, EITHER \r
EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES \r
AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A \r
PARTICULAR PURPOSE, OF ACCURACY, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. \r
PROPORTIONAL LIME TYPE FOUNDRY DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR \r
ENJOYMENT OF THE FONT SOFTWARE, THAT THE FUNCTIONS CONTAINED IN THE FONT SOFTWARE WILL \r
MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE FONT SOFTWARE WILL BE UNINTERRUPTED \r
OR ERROR-FREE, OR THAT DEFECTS IN THE FONT SOFTWARE WILL BE CORRECTED. NO ORAL OR \r
WRITTEN INFORMATION OR ADVICE GIVEN BY PROPORTIONAL LIME TYPE FOUNDRY SHALL CREATE A \r
WARRANTY. SHOULD THE FONT SOFTWARE PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL \r
NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION \r
OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO \r
THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.\r

6. Limitation of Liabilities\r

LIMITS OF LIABILITY AND INDEMNIFICATION: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, \r
IN NO EVENT SHALL PROPORTIONAL LIME TYPE FOUNDRY BE LIABLE FOR ANY DAMAGES WHATSOEVER, \r
INCLUDING, WITHOUT LIMITATION, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OR DAMAGES \r
FOR LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, \r
OR OTHER ECONOMIC LOSS ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF \r
PROPORTIONAL LIME TYPE FOUNDRY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. \r
CLIENT AGREES TO DEFEND, INDEMNIFY, AND HOLD HARMLESS PROPORTIONAL LIME TYPE FOUNDRY, \r
AND, AFFILIATES, OFFICERS, AGENTS, AND EMPLOYEES FROM AND AGAINST ANY CLAIM OR THIRD \r
PARTY CLAIM ARISING FROM OR IN ANY WAY RELATED TO YOUR USE OF THE SOFTWARE, INCLUDING \r
ANY LIABILITY OR EXPENSE ARISING FROM ALL CLAIMS, LOSSES, DAMAGES (ACTUAL AND \r
CONSEQUENTIAL), SUITS, JUDGMENTS, LITIGATION COSTS AND ATTORNEYS' FEES, OF EVERY KIND AND \r
NATURE. In no event shall Proportional Lime Type Foundry’s total liability to you for all damages (other \r
than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty \r
dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its \r
essential purpose.\r

7. U.S. Government End Users\r

The Font Software and related documentation are “Commercial Items”, as that term is defined at 48 \r
C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software \r
Documentation”, as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. \r
Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the \r
Commercial Computer Software and Commercial Computer Software Documentation are being licensed \r
to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are \r
granted to all other end users pursuant to the terms and conditions herein.\r

8. Controlling Laws and Severability\r

This License will be governed by and construed in accordance with the laws of the State of Ohio and \r
the United States of America , as applied to agreements entered into and to be performed entirely \r
within Ohio between Ohio residents. Any provision herein deemed invalid or unenforceable or contrary \r
to applicable law, such provision shall be construed, limited, or altered, as necessary, to eliminate the \r
invalidity or unenforceability or the conflict with applicable law, and all other provisions of this EULA \r
shall remain in effect.\r

9. Export Restrictions\r

The Font Software may not be exported or re-exported except in full compliance with all United States \r
and other applicable laws and regulations.
