Thank you for choosing to purchase an original KICKINGBIRD FONT. What you are purchasing is the \r
license to use digital typeface software - hereafter \"fonts\". By downloading and installing the fonts you \r
accept all the terms and conditions set forth below. KICKINGBIRD FONTS grants you a non-exclusive \r
license to use the fonts, provided that you agree to the following: \r

1. You may install and use the fonts on up to five computers at a single geographic location. You can \r
purchase additional licenses at any time, which grant you the rights to use the fonts on additional \r
computers.\r

2. You may make back-up copies of the fonts for archival purposes, provided that you retain exclusive \r
custody and control over such copies. You may take a digitized copy of the fonts to a commercial \r
printer or service bureau solely for use in the production of your own materials. Copying and \r
distribution to commercial printers or service bureaus is limited to those who clearly state that they are \r
duly licensed to use fonts.\r

3. You may embed the fonts in documents either as a rasterized representation of the font or as a \r
subset of the font as long as the document is distributed in a secure format that permits only the \r
viewing and printing but not the editing of the document.\r

4. You may modify and alter the fonts for your customary personal and business use, but not for resale \r
or further distribution. You agree that the fonts, and all copies thereof, are owned by KICKINGBIRD \r
FONTS, and its structure, organisation and code are the valuable trade secrets of KICKINGBIRD FONTS. \r
You acknowledge that the fonts are protected by copyright and design laws and by international \r
treaties. You may not rent, lease, sublicense, give, lend, or further distribute the fonts, or any copy \r
thereof, except as expressly provided herein. You agree that you will not distribute or disseminate all \r
or any part of the fonts through any on-line service. \r

5. You acknowledge that KICKINGBIRD FONTS is the exclusive owner of all worldwide right, title and \r
interest in and to the fonts, including without limitation all copyright, patent, trademark, trade secret \r
and other intellectual property rights, in and to the fonts as artwork, software, and otherwise, including \r
all copies of the fonts, regardless of the format in which they are expressed or the media on which they \r
are recorded. Any and all updates, revisions, enhancements or additions to the fonts shall automatically \r
be deemed to be included in the definition of \"fonts\" hereunder and shall become part of, and subject \r
to, this agreement. The names of these fonts are trademarks of KICKINGBIRD FONTS. All goodwill that \r
may become attached to the trademarks as a result of your use of the fonts shall inure to the exclusive \r
benefit of KICKINGBIRD FONTS. You agree not to challenge KICKINGBIRD FONTS' rights in or to the fonts \r
or the trademarks or the validity of any intellectual property or other right of KICKINGBIRD FONTS \r
therein, or to infringe KICKINGBIRD FONTS' rights therein. This agreement is not a grant to you of any \r
right, title or interest in or to the fonts or the trademarks except for the limited, non-exclusive, non-\r
transferable license to install and use the fonts as set forth above, subject to the terms and conditions \r
of this agreement. All rights not expressly granted herein are reserved to KICKINGBIRD FONTS.\r

6. The fonts are provided \"as is.\" To the extent permitted by applicable law, KICKINGBIRD FONTS \r
disclaims all warranties, representations and guarantees, express or implied, as to merchantability, \r
fitness for any particular purpose, or otherwise with respect to the fonts. In addition there is no \r
warranty of non-infringement and title or quiet enjoyment. To the extent permitted by applicable law, \r
KICKINGBIRD FONTS disclaims all liability for any loss, cost or damage, including without limitation \r
indirect, special, consequential, or incidental damages, including any lost profits or lost savings, loss of \r
goodwill, business interruption, work stoppage, loss of data, or computer failure, damage or \r
malfunction, or for any claim by any party, even if KICKINGBIRD FONTS has been apprised of the \r
possibility of such damages, and regardless of the theory upon which such claim is based.\r

7. If any part of this agreement is found void and unenforceable, it will not affect the vailidity of the \r
balance of the agreement, which shall remain valid and enforceable according to its terms. This \r
agreement shall automatically terminate upon failure by you to comply with its terms. The license \r
granted herein is effective until terminated. KICKINGBIRD FONTS has the right to terminate your license \r
immediately if you fail to comply with any term of this Agreement. Upon termination, you must destroy \r
the original and any copies of the fonts. We grant the rights of use of our fonts to you in good faith, \r
and request that you promise to adhere to the terms of this agreement to the best of your ability.
