This is a contract between you, the license purchaser, and !Exclamachine Type Foundry, for non-exclusive permission to use this typeface and the font software it is embedded in. If you do not agree to the following terms, do not purchase this license or install the font software. If you have any difficulties understanding this agreement, or determining if your intended use is allowed, please consult your lawyer, consider the other licenses available for this font, or contact !Exclamachine Type Foundry prior to purchase.\r

----- Allowed number of users, workstations, devices and/or archives -----\r

This font software may be installed on up to five (5) workstations, for access by no more than five (5) users in the employment or immediate family of the purchaser. A workstation is any device capable of manipulating or storing text and applying or storing font styles through user control. Type output may be sent to an unlimited number of printing or other rendering devices from those allowed workstations.\r

You may make an unlimited number of archive copies, subject to all the limits of this license.\r

----- Embedding and loaning your permission to use -----\r

The output of the software may be embedded in any manner of portable document or interactive electronic document, assuming a reasonable, common level of care is exercised to prevent extraction and/or installation of the font data.\r

If necessary, you may choose to install the font software on four (4) workstations, for no more than four (4) users, and send a copy of the software to a printing service bureau, for the exclusive purpose of printing your work. This copy may not be used by the service bureau for other purposes, or by anyone else.\r

You may not sell, give, transfer, lease or otherwise pass your license and privilege to use and possess this software without the prior documented approval of !Exclamachine Type Foundry, and agreement by the acquiring party to the terms of the license. !Exclamachine reserves the right to charge a transfer fee, or to refuse the transfer of rights.\r
Duration of agreement and conditions of use or modification\r
The agreement between you and !Exclamachine Type Foundry is unlimited in duration, assuming all conditions agreed to here are observed. Should you exceed these permissions, license to use or possess any copies of the software or software output is revoked.\r

Purchase of this font software means that you are free to use the output in any fashion, commercially or otherwise, with the following exceptions:\r
* Text specimens or samplers that present large, detailed, unaltered forms of a majority of the glyphs, or a majority of the most common glyphs, contained with the software for distribution. Text art, typographic experimentation, poetry concrete and other artistic modifications do not fall under this exclusion.\r
* Consumer-oriented mass-produced letter products including, but not limited to, glyph stickers, rub-on letters, building numerals, or other products that are essentially the type designs, outside the context of logotypes or words.\r
* In any way that implies that !Exclamachine Type Foundry, or any associated vendors, endorse your product or message. This includes misleading use of software and foundry trademarks, likenesses or names.\r
* Embedding the font software or its distinct type designs in other software or software packages, or otherwise including it in other interactive digital media.\r

You have the right to alter or modify the font outline data, as needed. This may be to include an otherwise missing accented character or for any other purposes. No modified software may be sold or licensed to a 3rd party. For the first two (2) years after release of the software, any modifications should be sent to !Exclamachine Type Foundry. Your compensation for any contributions is limited to free technical refreshes of the font software. Technical refreshes, if provided at all, will be available to any license holders upon request, for the same two (2) year period after initial release, at the discretion of !Exclamachine Type Foundry.\r

----- Warranty and Liability -----\r

THE PERMISSION TO USE THIS SOFTWARE IS SOLD “AS IS”, WITH NO WARRANTY OF FITNESS FOR ANY PARTICULAR PURPOSE, EXPRESS OR IMPLIED. ADDITIONALLY, THERE IS NO WARRANTY OF MERCHANTABILITY CLAIMED IN ANY WAY. !EXCLAMACHINE TYPE FOUNDRY IS NOT LIABLE FOR ANY LOSSES OR UNINTENDED RESULTS FROM USE, MISUSE, OR OTHER APPLICATION OF THIS FONT SOFTWARE, OR ISSUES OF SATISFACTION, SUITABILITY OR TIMELINESS. All remedies to the license purchaser, if not already waived, will be for the minimum allowed amount, as resolved through an arbitration service of !Exclamachine Type Foundry’s choice, in a location of their choice.
